A Father's Guide To Filing For Child Custody

By: Gen Wright Home | Home-and-Family

If you are a father filing for child custody there are some things you should be aware of. Filing for child custody is not difficult; however there are certain steps you should take to avoid pitfalls. This article will give you some easy ways you can file for child custody without getting the run-a-round.

1. You should really contact a lawyer that specializes in fathers getting custody. Get in the phone book and interview about 3-5 good attorneys and pick the one you get along with the best.

2. After you go through the interview process with the lawyers, you'll be able to decide if you want to hire the lawyer to file your custody case or if you'd rather save the money and do it yourself.

3. Do some research online about your state's requirements for child custody. (Hint) While you are at the lawyer's office, ask him or her about your state's specific child custody requirements and how you can get more information about it.

4. Go online and review some of the blogs and forums about child custody for dads and get an idea of what to expect. There are thousands upon thousands of fathers that have gone through this and they are usually more than happy to help you on the forums.

5. Find out which courthouse handles the child custody cases in your county. Usually the family court will handle this stuff. If you are unsure, then just call the county clerk's office for further instruction.

6. You'll need to file a custody petition. Often the county clerk can give you information on how to do this, but you'll probably have to go to the courthouse to file the petition.

7.Make sure you have ALL the important documents and information with you when you go to the courthouse and file for petition. You'll need things like you and your child's birth dates, home address, social security cards, birth certificates, work addresses and so on. These are all important documents so make sure you bring them to speed things up.

8. This can be boring and frustrating; however you need to be patient and courteous to the folks in the courthouse. They are usually busy, so bring a book or something to work on while you wait.

9. Ask, ask, ask, ask, ask, ask, and ask. Make sure you ask all the questions you have on your mind when you're at the courthouse. Ask them what form you need to fill out, is there a fee for filing, does the other party have to sign the paper and so on. Leave no rock unturned here

10.Make sure that you have properly completed every section of the paperwork before it gets submitted. If you didn't fill it out properly, it could take weeks before they get back to you. Remember, they are very busy at the courthouse and they don't have time to deal with paperwork that is not properly filled out. It may just get rejected.

Make sure you do your homework here so your paperwork does not get lost in the shuffle. If you are a father who's seeking full custody of your child, then don't be afraid to invest in some good information about how to get custody of your child. There's a wealth of knowledge available for you online or in the libraries, so make sure you take full advantage of it.
