Personal Injury Attorney Selection Tips

When someone??s action causes an injury to you or to a loved one, it is natural that you expect to be offered a compensation either directly or via an insurance company settlement. But you might be surprised to know that this rarely happens in the real world. Too many people get away with it ?? they fail to accept the responsibility for their actions and the insurance companies conveniently do not compensate. Insurance companies and their lawyers know every the nook and corner of the law and also know that the common man is limited in their knowledge of personal injury law and the facilities that the law offers them.

Experienced lawyers know how to consult the case with the insurance company and take the case to trial if necessary. If we consult the case with the insurance company ourselves, the company typically takes advantage of our inexperience and settles a lower amount as compensation but a lawyer can usually obtain a much higher settlement. Most lawyers that accept personal injury cases get reliant fees. In other words, their fees are a percentage of the compensation awarded to you. So, if you are not awarded any compensation, the lawyer does not get anything either.

Lawyer fees varies from state to state. The attorney??s fee will be one third or forty percent of the compensation in most states, though some do it for as little as 25%. Workers compensations are more regulated for the accidental injury matters. If your case is worth a larger amount, lawyers may sometimes try to reduce the contingent fees. But don??t always go by the fees. Often the ones that charge a larger percentage are the ones that know how to bring you the highest compensation as well. So how do you know which lawyers are good and deserve the money they charge?

There are numerous sources which provide the names of attorneys as per your need. The better way to find a personal injury lawyer is to consult with the lawyer you know or get suggestions from friends or health care professionals. Also, you get information by searching an online lawyers?? directory or contact a State Bar lawyer referral service. If a lawyer is unable to take up the case, then they might refer you to some other lawyer who can handle it better and collect a ??referral fee?? in the process. It is usually about a quarter to a third of the fee received by the personal injury lawyer who handles your case. You have every right to know whether the attorney referring your case is getting a referral fee. Referrals are not bad as long as the referral is not happening for the money alone. That??s why we recommend that you go with a personal referral of a health-care provider referral whenever possible.

Some State Bar organizations find and refer attorneys. Usually, any member of the organizations can list with its referral service, and you never know who exactly is qualified to handle your case. A specialized organization "American Association for Justice (AJJ)" offers online directories for the referrals of its member. Most lawyers with significant personal injury practices are the members of the AAJ.
Yellow Pages offer two ways to find an attorney. The first way is to find them through their ads and the other way is to find them outside the area. Most of the biggest ads are from the lawyers who think that the larger ads bring them more cases. Many of these lawyers have handled very few personal injury cases, and some have never had even attended a single injury trial. But the truth is the best personal injury lawyers do little or no advertising at all. The yellow pages can provide some degree of confirmation that a particular law firm is established, but even a big advertisement does not certify that a firm is qualified to handle your case.

Consider the following list to ask before selecting the attorney:
- The area of specialization of the attorney
- History of previously handled cases.
- The number of lawyers need to complete the case.
- Time required for the case to be resolved.
- Whether the case was taken on contiguous fees?
- Information on progress of the case.
- If the lawyer is unavailable or on vacation, who will be the lawyer to speak with?
- Duration of the trial
- Ask the lawyer whether he is disciplined by an ethics committee, or been suspended from the practice of law

The state Bars offers resolution services, if a quarrel arises between you and your lawyer. If you feel that your lawyer has acted in an unethical manner, each state has a "grievance" procedure where you can file a complaint against the lawyer and have the complaint investigated.
