The Fair Debt Collection Practices Act- There Is Good News

By: Norman Taylor Home | Legal

The United States government passed a Federal law to protect debtors from abusive debt collectors. The law, which was added in 1978 as Title VII of the Consumer Credit Protection Act, is called the Fair Debt Collection Practices Act (FDCPA). The purpose of this statute is to eliminate abusive practices from debt collectors. There is plenty of evidence out there of abusive, deceptive, and unfair debt collection practices by many debt collectors today.

Abusive debt collection contributes to a number of personal bankruptcies, to marital instability, to the loss of jobs, and to invasions of individual privacy. Despite the fact that one may be in debt, there are certain rights that cannot be violated without substantial penalty to the abusing debt collector. Basically, the Fair Debt Collection Practices Act assures debtors the right to pay back without the pointless exposure to harassment and abuse that occurs too often today.

Debt collectors use a variety of ways to embarrass, annoy and wear down debtors. This includes calling the debtor at inconvenient times of the day, calling their place of employment after being asked not to and calling an excessive number of times a day, all of which can seriously affect the lives of debtors. Frustrating the debtor may in turn get debtors to pay debt collectors to get them off their back. In fact, some debt collection agencies turn a blind eye to this kind of devious behavior because they can count on consumer's not knowing the full extent of their rights or who to contact should they be exposed to this type of behavior. Debt collection abuse is rampant, fortunately, there are some debt collectors that use fair debt collection practices and make an effort to abide by the federal law.

The best ally in this scenario is to contact a qualified experienced consumer advocate to get the facts.
